My personal guess is that Swordsman Kirby is right, or that neither king was in check at all...

Or that one king was in check and the inspector didn't know who's turn it was.

Actually, I'm guessing and don't have a clue.

Crazy idea...what if the inspector looked at the board sideways? He would have seen the 2 black pawns at both sides and come to his conclusion. Perhaps when the guys set the board up they were turning it around when the inspector came in? This solution would have nothing to do with the position of the kings. He took the kings away symbolically as it says in the puzzle.
Looking for the position of the kings yields too many possibilities.

My favourite's still 3iff's idea from post 28. All these inverted-board theories don't do much for me; IMHO, such a nasty trick would take part of the fun out of the puzzle...

I agree, post 28 is the only good solution so far, and it fits the storyline very well. The inverted board theory, aside from being a nasty trick, simply doesn't work on its own. There are many ways to place the kings that are impossible with the board oriented one way but possible with the board inverted. Since we're presumably looking for a unique solution, the inverted board theory can't be right unless we add another nasty twist on top of it, but that would probably be overkill.

The correct solution is the capturing with the tricky en passant.

Well, I'm astounded...having lurked here on and off, I actually get one of these things right...and that after deciding that the puzzle was impossible to solve after 10 minutes...
